The client is required to read and understand these terms and conditions before purchasing a product or utilising a service at Lalapanzi Sit Gerus. The terms and conditions are deemed to be accepted upon payment of the deposit amount required in terms of the quotation.
The client agrees that they have the intention to purchase a product sold or service delivered by Lalapanzi Sit Gerus and that Lalapanzi Sit Gerus has the intention to sell the product or deliver the service to the client.
As far as it has been agreed between the parties (Lalapanzi Sit Gerus and the client) in writing, Lalapanzi Sit Gerus will manufacture a product alternatively upholster an item, according to the specific instructions received from the client.
Products will only start being manufactured and/or the upholstery process will only commence once a deposit has been received into the bank account of Lalapanzi Sit Gerus.
The general manufacturing/upholstery period is between 4 and 15 business days. The manufacture/upholstery period will depend on the design and material required for the product.
A standard product displayed on the website of Lalapanzi Sit Gerus and bought by a client, may be exchanged within a day of delivery to the client, if the product has not been used or damaged.
There is no product exchange at Lalapanzi Sit Gerus for products that have been customarily designed to specific orders of the client.
By paying the deposit in terms of the quotation, the client consents to Lalapanzi Sit Gerus collecting personal information required to provide the client with the necessary quotation to fulfil its services to the client. This personal information is only used for the purpose for which it is obtained in delivering the goods and services as outlined in the quotation. Lalapanzi Sit Gerus ensures that this information is stored in a secured location and is destroyed within a reasonable period as required in terms of the Protection of Personal Information Act 4 of 2013.
Ownership
Ownership of the product will vest with Lalapanzi Sit Gerus until such time as the full purchase price has been paid in accordance with the invoice sent to the client.
Lalapanzi Sit Gerus reserves their right to sell the product ordered by the client if the invoice remains outstanding for a period of more than 30 (thirty) days.
If Lalapanzi Sit Gerus is in possession of items to be upholstered and those items are not collected within 30 (thirty) days of the item being ready for collection, a demand will be made on the client to collect the item within 7 (seven) days of a notice to collect being sent to the client. If the item remains in possession of Lalapanzi Sit Gerus after the 7 (seven) day notice period then the client will be deemed to have abandoned ownership of the item and Lalapanzi Sit Gerus will dispose of the item as it deems necessary.
Lalapanzi Sit Gerus holds a lien over all items provided to it for the purpose of delivering an upholstery service or any other service provided by Lalapanzi Sit Gerus.
Lalapanzi Sit Gerus will exercise its rights in terms of the lien in the event of any outstanding accounts.
Failure to pay the invoice provided to the client within a period of 30 (thirty) days will be viewed as a tacit cancellation of the contract between the parties. The cancellation fee will be deducted from the deposit received from the client (if any) and the product will be sold to another interested purchaser.
The client will be refunded the balance of the deposit amount (if any) after the cancellation fee has been deducted.
If the client is already in possession of the product without the full purchase price being settled, legal steps will be taken to procure the payment of the outstanding amount in terms of the invoice provided to the client.
The client will be liable for all legal costs incurred in pursuit of any outstanding payment owed to Lalapanzi Sit Gerus on an attorney and client scale.
Warranty & Guarantee
Products purchased from Lalapanzi Sit Gerus has a warranty period of one (1) year, unless otherwise specified on the invoice of the client and unless there has been gross conduct on the side of the client to compromise the product.
A guarantee period of 2 (two) years applies to the frame of the products supplied by Lalapanzi Sit Gerus.
A guarantee of 1 (one) year applies to the workmanship of the products supplied by Lalapanzi Sit Gerus.
Lalapanzi Sit Gerus does not provide a guarantee on the trim or the material used to cover its products.
Cancellation
The client has the right to cancel the order in terms of the Consumer Protection Act 68 of 2008.
20% of the deposit amount paid will be charged on cancellations made between 4 and 7 days of acceptance of the quotation.
20% of the deposit amount paid plus the reasonable costs incurred on the order up until date of cancellation of the order, will be charged on cancellations made after 7 days of acceptance of the quotation.
No cash refunds will be provided for products purchased at Lalapanzi Sit Gerus. Clients will be provided with a credit note to purchase another product at Lalapanzi Sit Gerus.
Force Majeure
Lalapanzi Sit Gerus shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, accidents, war, fire, and Lockdown regulations.
Lalapanzi Sit Gerus reserves the right to accommodate the client at a date which is convenient for both parties.
If the reason persists for such time as Lalapanzi Sit Gerus considers unreasonable, it may, without liability on its part, terminate the contract.
Price & Payment
The client will be provided with a quotation for the product and/or the service the client wishes to purchase.
The quotation will be valid for a period of 5 business days.
The quotation and these terms and conditions are deemed to be accepted upon the payment of the deposit amount required in terms of the quotation.
Once the quotation has been accepted work will start on the product and/or service requested by the client.
Pricing is subject to change at any time and the final price will be confirmed with an invoice to the client.
All deliveries will only be done once the balance of the invoice provided to the client is paid in full and cleared into the bank account of Lalapanzi Sit Gerus.
A cash deposit fee of 4% of the transaction value will be added on any cash deposits received (with a minimum of R55.00 being charged for all cash deposits received).
No cash on delivery arrangements will be accepted.
External drivers hired by Lalapanzi Sit Gerus to deliver products to clients cannot collect cash or payments of any form from the client.
